Distance Sales Agreement

This is a distance-sales pre-contractual information and agreement draft, prepared in line with Turkish Law No. 6502 on the Protection of Consumers and the Distance Contracts Regulation. Turkish law and the Turkish-language version govern; this translation is provided for convenience only.
1. Parties

Buyer: the individual or entity placing an order electronically via hektors.com.tr ("Consumer").
2. Subject and Scope
This agreement sets out the rights and obligations of the parties, under Law No. 6502 and the Distance Contracts Regulation, regarding the sale and delivery of the product(s) the Buyer orders electronically via hektors.com.tr, whose characteristics and sale price are described on the site.
The order confirmation constitutes acceptance of all terms of this agreement. The contract is formed at the moment the Buyer confirms the order; a confirmation email with the order summary, price and delivery details is sent separately.
3. Product and Payment Details
The essential characteristics of the product (type, quantity, brand/model, colour, etc.) are listed on its product page on hektors.com.tr. The sale price shown on the site at the time of order (VAT included) applies.
Payment is collected via credit or debit card through iyzico's 3D Secure infrastructure. The Seller never stores or processes card data — it is handled directly by iyzico.
4. Delivery
Products are shipped to the address provided by the Buyer at checkout, via our partner couriers (Sürat Kargo / HepsiJET), within the timeframes described on the Shipping & Delivery page.
Unless otherwise agreed, the Seller fulfils the order within 30 days at the latest, as required by law. If delivery cannot be completed within this period, the Buyer may terminate the contract.
5. Right of Withdrawal
The Buyer has the right to withdraw from this agreement within 14 days of receiving the product, without giving any reason and without penalty.
To exercise this right, the product's packaging must be unopened, unused and in resalable condition, and written notice must be sent to hektor@hektors.com.tr within the period.

6. Exceptions to the Right of Withdrawal
Under Article 15 of the Distance Contracts Regulation, the right of withdrawal does not apply to goods whose packaging, seal or protective wrapping has been opened after delivery and whose return is not appropriate for health and hygiene reasons. Accordingly, food-supplement products with an opened package or protective seal are excluded from the right of withdrawal.
7. Default and Legal Consequences
If the Buyer defaults on a card payment, they acknowledge they will be liable to their card-issuing bank under their own cardholder agreement, including any applicable interest, and that the bank may pursue legal remedies accordingly.
8. Force Majeure
Natural disasters, war, strikes, communication or infrastructure failures, supply shortages, decisions by competent authorities, and similar events beyond either party's reasonable control are considered force majeure. Neither party is liable for failing to perform its obligations as a result of such events.
9. Dispute Resolution
Disputes arising from this agreement are subject to the Consumer Arbitration Committees of the Buyer's or Seller's place of residence, within the monetary limits announced annually by the Ministry of Trade, or the Consumer Courts for disputes exceeding those limits.
10. Effective Date
By confirming the order, the Buyer declares that they have read, understood and accepted all terms of this agreement. The agreement takes effect upon order confirmation.
